Terms & Conditions

These Terms are important so please read them carefully. They apply to your activities on various platforms/websites including Gumroad (https://gumroad.com/thecryptocircle), thecryptocircle.co.uk, tcc-capital.com, Discord, the Telegram, and other applications and/or websites used by TCC (together the “Applications”). Part 1 will always apply when you use any of the Applications but other Parts of these Terms only apply when you do certain things on the Application(s), like order our services.

You should only use the Application(s) if you agree with these Terms. Upon purchase of the Services and/or by using the Application(s), you will be legally bound by these Terms. We recommend that you print a copy for your records.

We may change these Terms from time to time so you should check back regularly to see if anything has changed but we will also notify you of any significant changes either on the Application(s) or by email. Changes will become effective from the next time that you access your Membership. Changes we make which are necessary to comply with law or which enhance our Services or are minor will apply automatically.

PART 1 – GENERAL

1 WHO WE ARE, WHAT WE DO AND CONTACTING US

(a) We are TCC Trading Limited (“TCC”).

(b) The TCC is an online trading community which provides assistance and guidance on various asset classes including crypto, FX and other asset classes (as applicable). TCC provide various services which include: one to one consulting advice (“Consultancy Advice”); digital content including the Crypto Blueprint and other information materials (“Digital Content”); a discord based service which aims to take novice or experienced traders and turn them into fully funded traders (the “HUB”); and any other ancillary services provided (together, the “Services” (which are described in more detail on Gumroad)) and other services that TCC may make available through the Application(s). Please note, if you purchase the Crypto Blueprint, you become a member of the TCC community and other ancillary services may be provided.

(c) If you have any questions about anything in these Terms, our Services, or if you wish to make a complaint, then just contact TCC at the.crypto.circle1@gmail.com. If you have any technical issues with the Application(s), please contact the same email address.

2 MEMBERSHIP

(a) You may need to obtain a membership with TCC to use certain Services available on the Application(s). A membership includes any involvement with any of the Applications and/or any of your involvement with the Services (“Membership”). You must be at least 16 (sixteen) years old. These Terms are governed by the laws of England and the English Court have exclusive jurisdiction for any claims arising from these Terms.

(b) You must ensure that any usernames, email addresses and passwords used are kept secure and confidential. You are responsible for any activity regarding your Membership. It is your sole responsibility to monitor and control access to and use of your Membership. You agree to keep your information accurate, complete and current.

(c) You may make copies of your information contained in your Membership in any format and in doing so, you may make copies of reasonable portions of the Application(s) and the material and content of the Application(s) and your Membership.

3 YOUR RIGHTS AND RESTRICTIONS

(a) The Application(s) is for your own personal and non-commercial use only.

(b) When using the Application(s) and your Membership, you agree not to:

(i) attempt to undermine the security or integrity of the Application(s), TCC’s computing systems or networks (or its suppliers’). TCC will report any security breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them;

(ii) use, or misuse, the Services or Application(s) in any way which may impair the functionality of the Services or Application(s), or other systems used to deliver the Services or Application(s) or impair the ability of any other user to use the Services or Application(s);

(iii) attempt to gain unauthorised access to any materials other than those to which you have been given express permission to access or to the computer system on which the Services or Application(s) are hosted;

(iv) transmit, or input into the Services or Application(s), any files, content or data that may damage any other person’s computing devices or software, content that may be offensive, or are in violation of any law (including data or other material protected by copyright or trade secrets which you do not have the right to use);

(v) create links to the Application(s) unless TCC gives you prior written consent;

(vi) attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any computer programs used to deliver the Services or to operate the Application(s) except as is strictly necessary to use either of them for normal operation and other than as permitted by law;

(vii) impersonate any other person while using the Application(s);

(viii) conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the Application(s); or

(ix) use the Application(s) for any unlawful purpose.

(c) if you use any communication tools available through the Application(s) (such as any forum, chat room or message centre though the discord), you agree only to use such communication tools for your domestic purposes and in accordance with the law. You must not use any such communication tool for posting or disseminating any material unrelated to the Application(s) or for advertising or marketing purposes.

(d) When you make any communication on the Application(s), you represent that you are permitted to make such communication. Any communications shall be conducted in a courteous manner. TCC is under no obligation to ensure that the communications on the Application(s) are legitimate or that they are related only to the use of the Services.

(e) You may have other rights granted by law, and these Terms do not affect these except if the two are inconsistent. If this is the case then these Terms will override any other rights which you may have, unless this is not permitted by law.

4. YOUR DATA

(a) TCC takes its responsibility for care of your data very seriously. Please see the Privacy Policy for information on how TCC processes your data.

5. DISCLAIMERS

(a) These Applications and the Services are provided on an information-only basis and you should not rely on, or take (or not take) any decision based on any information, results, suggestions found on or obtained through these Applications. Any actions or decisions that you take are entirely at your own risk and none of our Services are considered financial advice regulated by the Financial Conduct Authority.

(b) Other than as set out in these Terms the Applications are provided on an “as is” and “as available” basis. TCC makes no representations or warranties of any kind, express or implied, as to the operation of the Application(s) or the Services or any information, content, materials or products included or referenced on the Application(s).

(c) TCC does its best to ensure that the information accessed through the Application(s) is accurate and up to date but cannot guarantee that this will always be the case.

(d) TCC aims to make the Application(s) available to you all the time but sometimes it may be unavailable due to maintenance or to factors outside of TCC’s control, such as the internet and using other third party applications e.g. the discord, Gumroad, the Telegram etc.

(e) TCC follows industry standards and processes to prevent against the introduction of viruses, malware and malicious attacks that may harm the Application(s) or the device that you use to access the Application(s), but TCC cannot guarantee that the application will be totally free from viruses and malware.

(f) TCC does not guarantee that the Application(s) will be compatible with all hardware and software that you may use.

(g) The Application(s) may contain links to third party Applications or programs that are not controlled by TCC. TCC is not responsible for the content, terms and conditions, offers or privacy policies of such sites and programs. Your dealings with third party sites are solely between you and the applicable third party and you should read their terms and conditions and policies before using them.

6. TCC’S RIGHTS AND OBLIGATIONS

(a) TCC may change, modify, amend or remove some or all of the functionality or content on the Application(s) at any time in accordance with the relevant Application’s term and conditions (if applicable).

(b) TCC reserves the right to remove any communication or any material held within any of the Applications at any time in its sole discretion.

(c) You agree that TCC is free to use any comments, information or ideas contained in any communication you may send to TCC without compensation, acknowledgement or payment to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Application(s), Services or other products or services.

(d) TCC and/or TCC’s licensors are the owners of the Application(s), which includes (but without limitation) any software, applications and domains made available through it.

(e) All intellectual property rights in the Application(s), and the content (except the personal information of you and other users contained your and their Memberships), video, audio, graphics, logos, icons and service names which appear on the Application(s) belong, or are licensed, to TCC. You do not have any rights to such intellectual property except as expressly set out in these Terms.

(f) These Terms do not exclude or limit TCC’s liability (if any) for:

(i) death or personal injury caused by TCC’s negligence;

(ii) fraud;

(iii) fraudulent misrepresentation; or

(iv) any matter which it would be illegal for TCC to exclude or attempt to exclude TCC’s liability.

(g) TCC is only liable to you for losses which you suffer as a direct result of TCC’s breach of these Terms and which are reasonably foreseeable. TCC is not liable for any other losses or for business losses (including but not limited to loss of profits, contracts, goodwill or opportunity).

7. SUSPENSION AND TERMINATION

7.1 You can terminate these Terms at any time by cancelling your subscription via Gumroad or Launchpass. If you do so, you will no longer be able to access your Membership or the information held in your Membership.

7.2 TCC may suspend access to your Membership or terminate your Membership at any time and for any reason. TCC will tell you as soon as possible if TCC suspends or terminates your Membership.

8. GENERAL

8.1 These Terms and all communications between us will be in English. No other languages will apply to these Terms.

8.2 You may not transfer any of your rights under these Terms to any other person.

8.3 TCC may transfer any of its rights under these Terms to any person or ask any person to fulfil any aspect of it so long as the performance of these Terms is not affected.

8.4 Only you and TCC have any rights under these Terms. No other person shall have any rights under these Terms.

8.5 These Terms will be governed by English law and any court proceedings related to these Terms must be taken at a court within England and Wales.

PART 2 – ORDERING OUR SERVICES

This Part applies to your orders for our Services.

 

9 ORDERS AND CONTRACTS

(a) Through the Application(s), you can order the Services made available by TCC on the Application(s).

(b) TCC are under a legal duty to provide Services that conform with their description on the Application(s) and these Terms.

(c) When you submit an order on the Application(s) for the following Services, TCC will

(d) When you submit an order on the applicable Application to purchase the relevant Services, TCC will send you an email to confirm receipt of your order. Your order is only accepted after TCC has sent you a further email stating your order number and received your payment. When the order is accepted, you will have entered into a contract incorporating these Terms (“Contract”) with TCC for the Services you have ordered.

(e) You must keep your contact details in your Membership up-to-date so that TCC can contact you about your order.

(f) If you realise there is an error in your order, please contact TCC as soon as possible at the details in paragraph 1(c).

 

10. CANCELLATION OF ORDERS

(a) The following clauses do not affect your rights of cancellation which exist under any local mandatory laws which apply in the country in which the Contract between you and TCC was formed.

(b) If you are a consumer (i.e. not buying the Services in the course of your business, trade or profession), then you may cancel your Contract for the Services without giving any reason by informing TCC in writing that you wish to cancel within 14 days from the date of the Contract. For example, if you order the HUB on a yearly plan, payment will be taken upon sign up of the yearly plan and we will charge you for the initial 12 months. You will only have 14 days from purchasing the yearly plan to cancel the plan in accordance with your statutory rights. If you order the Hub on a monthly plan, you will have access to the Hub straight away therefore, you forfeit you right to cancel the monthly plan as we provide the Services simultaneously. Please see termination of the monthly plan below regarding your rights to terminate the HUB.

(a) However, if you instructed TCC to start performance of any Services ordered, then you will have no right to cancel the Services if TCC have completed performance of the Services. For example, once you purchase The Crypto Blueprint or any other Digital Content, you forfeit your cancellation rights.

(b) To exercise your right of cancellation, you must send an email to TCC at the.crypto.circle1@gmail.com. In the email copy and fill out the Cancellation Form you can find at the end of these Terms. If you use this option, TCC will acknowledge receipt of such a cancellation by email without delay. Your notice needs to reach TCC before the cancellation period expires.

(c) If you decide to cancel your order, TCC will reimburse you for all payments which TCC have received from you in relation to your order excluding for expedited/quicker delivery.

(d) TCC will make the reimbursement without undue delay, and no later than 14 days after the date TCC received your cancellation email.

(e) TCC will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise you will not incur any fees as a result of the reimbursement.

If TCC has begun the Services (except for the Digital Content and the HUB) before the end of the 14 day cancellation period and then you choose to cancel, you will pay TCC a charge to compensate for Services already performed.

PART 3 – PAYMENT

11 PAYMENTS

(a) All prices set out on the Application(s) which are inclusive of all taxes payable in the United Kingdom.

(b) You may pay for the Services: (i) using your credit or debit card; or (ii) using such e-wallets or e-money as are accepted on the relevant Application from time to time.

(c) You have to enter your chosen payment method and details when you submit your order. By completing your payment details, you confirm that the method of payment being used belongs to you.

(d) Your credit or debit card Membership will be debited with the cost of the Services and any postage and packaging costs on submission of your order.

(e) All payments are subject to the approval of the financial institution issuing your credit/debit card and credit verification or the provider of e-money or an e-wallet, and TCC will not be responsible if the payment fails credit verification or if such financial institution or provider refuses to accept or honour the payment for any reason. TCC may also report any suspicious transactions to the relevant authorities. TCC may reject any order without giving any reason. Please note that it can take 2 to 3 days (excluding weekends and bank holidays) to process your payment. TCC will tell you if it incurs any issues obtaining approval for the payment. This may cause a delay in delivering the Services to you and TCC will not be able to accept your order and deliver the Services until TCC has received authorisation.

PART 4 – TERMINATION OF THE HUB

12 TERMINATION

(a) You may terminate your access to the HUB subscription immediately at any time by cancelling through Gumroad or Launchpass and you will be automatically removed from the Discord channel.

(b) You will not be entitled to a refund if you have paid any payments in advance as discussed above in Clause 10(b). This does not affect your statutory rights.

(c) TCC will not collect any future payments if you terminate the HUB subscription via Gumroad or Launchpass. You will not receive any refunds for any subscriptions paid before the date of termination.
